AGREEMENT TO OUR LEGAL TERMS

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “Contractor”) and Sure Level Concrete (“Sure Level Concrete,” “we,” “us,” or “our”).

These Terms govern your access to and use of our website, advertisements, lead generation services, consultation processes, and related services provided by Sure Level Concrete (collectively, the “Services”).

By accessing our website, submitting information, scheduling a consultation, entering into a partnership, or using our Services, you agree to these Terms. If you do not agree, you should not use our Services.

You represent that you are at least 18 years old and have the legal authority to enter into these Terms.

1. OUR SERVICES

Sure Level Concrete provides lead generation and marketing services designed to help concrete lifting and leveling contractors connect with potential homeowner customers.

Our Services may include:

• Generating homeowner leads through advertising campaigns
• Collecting and qualifying homeowner inquiries
• Delivering qualified leads to contractors
• Providing marketing and lead generation solutions

Sure Level Concrete does not perform concrete lifting, leveling, foundation repair, construction, or contracting services.

We are a marketing and lead generation company. We are not a contractor, employer, agent, partner, or representative of any contractor using our Services.

2. CONTRACTOR ELIGIBILITY

To use our Services, you represent that:

• You are at least 18 years old
• You operate a legitimate business
• You have any licenses, permits, insurance, and qualifications required to perform your services
• All information provided to Sure Level Concrete is accurate and complete

We reserve the right to refuse service or terminate relationships with businesses that provide inaccurate information, misuse our Services, or fail to meet our requirements.

3. HOW OUR LEAD GENERATION SERVICE WORKS

Sure Level Concrete generates homeowner inquiries through advertising campaigns, landing pages, websites, forms, and other marketing channels.

Depending on your service arrangement, leads may include:

• Homeowner name
• Phone number
• Email address
• Property location
• Requested service information
• Project details
• Qualification information

Leads are delivered to contractors for the purpose of allowing contractors to contact homeowners and pursue potential business opportunities.

Receiving a lead does not guarantee that the homeowner will purchase services.

4. LEAD QUALIFICATION

Sure Level Concrete makes reasonable efforts to generate and deliver leads that match agreed-upon criteria.

A qualified lead may be determined based on factors including:

• Requested service type
• Service location
• Homeowner contact information
• Project details
• Timeline
• Other qualification criteria communicated during onboarding

Lead quality may vary due to factors outside of Sure Level Concrete’s control, including homeowner availability, budget, responsiveness, competition, pricing, and market conditions.

A qualified lead does not guarantee a booked estimate, closed job, revenue, or profit.

5. LEAD EXCLUSIVITY

Unless otherwise agreed upon in writing, leads provided through Sure Level Concrete are intended to be exclusive to the contractor receiving them within the agreed service area.

Exclusivity applies to the delivery of leads through Sure Level Concrete and does not guarantee that homeowners have not independently contacted, searched for, or received marketing from other contractors or sources.

6. LEAD DISPUTES AND REPLACEMENT POLICY

Any lead disputes or replacement requests must be submitted within the timeframe and process communicated during onboarding.

Lead disputes will be reviewed based on the agreed qualification criteria.

A lead may qualify for replacement or credit if it does not meet the agreed-upon criteria.

Leads generally will not qualify for replacement solely because:

• The homeowner does not answer
• The homeowner changes their mind
• The contractor does not close the job
• The contractor is unable to contact the homeowner
• The homeowner chooses another provider

Sure Level Concrete reserves the right to determine whether a lead qualifies for replacement or credit based on the agreed criteria.

7. PAYMENT TERMS

If you participate in a paid lead program, you agree to the pricing, payment structure, and terms communicated during your onboarding process.

Depending on your agreement, payment may be based on:

• Individual leads received
• Agreed lead packages
• Other mutually agreed arrangements

You are responsible for providing accurate billing information and paying all applicable charges.

Failure to make required payments may result in suspension or termination of Services.

8. CONTRACTOR RESPONSIBILITIES

Contractors are solely responsible for:

• Responding to homeowner inquiries
• Communicating with homeowners
• Providing estimates and pricing
• Performing services
• Maintaining required licenses and insurance
• Following all applicable laws and regulations

Any agreement, transaction, or service performed between a contractor and homeowner is solely between those parties.

Sure Level Concrete is not involved in, responsible for, or liable for any contractor services.

9. INDEPENDENT CONTRACTOR RELATIONSHIP

Contractors using Sure Level Concrete’s Services operate as independent businesses.

Nothing in these Terms creates:

• An employment relationship
• A partnership
• A joint venture
• An agency relationship

Contractors are solely responsible for their own business operations, employees, taxes, insurance, and obligations.

10. CONTRACTOR INFORMATION AND DATA USE

By submitting information through our website, forms, advertisements, or consultations, you authorize Sure Level Concrete to use your information for purposes including:

• Communicating about our Services
• Evaluating partnership opportunities
• Providing information about our services
• Improving our marketing and operations

We do not sell contractor information to unrelated third parties.

11. SMS AND COMMUNICATIONS

By providing your phone number, you consent to receive communications from Sure Level Concrete regarding your inquiry, account, Services, and potential business opportunities.

Communications may include:

• Phone calls
• SMS/text messages
• Emails

Communications may be sent using automated dialing systems or prerecorded messages where permitted by applicable law.

12. INTELLECTUAL PROPERTY

13. PROHIBITED USES

We are not responsible for the availability, actions, or privacy practices of third-party services.

15. TERMINATION

Either party may terminate use of the Services unless otherwise agreed upon in writing.

Sure Level Concrete reserves the right to suspend or terminate Services for:

• Violation of these Terms
• Unpaid balances
• Misuse of leads
• Fraudulent activity
• Conduct that may negatively impact homeowners or business relationships

Termination does not remove any outstanding payment obligations.

16. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SURE LEVEL CONCRETE SHALL NOT BE LIABLE FOR:

• Lost profits
• Lost business opportunities
• Contractor conversion rates
• Homeowner decisions
• Contractor performance
• Indirect, incidental, or consequential damages

Sure Level Concrete does not guarantee specific business results, revenue, job volume, or return on investment.

Our total liability shall not exceed the amount paid by you to Sure Level Concrete during the preceding three months, if applicable.

17. DISCLAIMER

Services are provided on an “as available” basis.

We make no guarantees regarding:

• Lead volume
• Business growth
• Revenue outcomes
• Closed jobs
• Contractor success

Marketing results vary based on many factors outside of our control.

Sure Level Concrete is not responsible for delays, interruptions, or failures caused by circumstances outside of our reasonable control, including advertising platform changes, technical issues, internet outages, third-party service interruptions, or other unforeseen events.

18. INDEMNIFICATION

You agree to indemnify and hold harmless Sure Level Concrete from claims, damages, liabilities, or expenses arising from:

• Your business operations
• Your services provided to homeowners
• Your communications with leads
• Your agreements with customers
• Your violation of these Terms

19. PRIVACY POLICY

Your use of our Services is also governed by our Privacy Policy available at:

Our Privacy Policy explains how we collect, use, and protect information.

20. MODIFICATIONS

We may update these Terms at any time.

Updated Terms will be posted on this page with a revised “Last Updated” date.

Continued use of our Services after changes are posted constitutes acceptance of the updated Terms.

21. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain effective.

22. WAIVER

Failure to enforce any provision of these Terms does not waive our right to enforce that provision in the future.

23. GOVERNING LAW

These Terms are governed by the laws of the Commonwealth of Pennsylvania.

24. DISPUTES

Any disputes arising from these Terms or the Services shall be resolved exclusively in the state or federal courts located in Delaware County, Pennsylvania.
